Blame Without Punishment for Addicts

چکیده
On the moral model of addiction, addicts are morally responsible and blameworthy for their addictive behaviours. The is sometimes resisted on grounds that blaming incompatible with treating addiction in a compassionate non-punitive way. I argue consistent addressing compassionately non-punitively better accounts both role addicts’ agency recovery process. If an addict behaviours, behaviour some way bad or wrong, then blameworthy. not, they not. But, if which contributes to perpetuates condition not issue concern. Addicts blameworthy, but attributions blame need be followed by harsh treatment punishment. Because punishment can separated, there no good reason reject addiction.

In criminal law, the mental state of the defendant is a crucial determinant of the grade of crime that the defendant has committed and of whether the conduct is criminal at all. Under the widely accepted modern hierarchy of mental states, an actor is most culpable for causing harm purposely and progressively less culpable for doing so knowingly, recklessly, or negligently. Notably, this hierarc...

متن کاملAttribution Bias, Blame, and Strategic Confusion in Punishment Decisions∗
Disentangling the roles of intentional effort and luck is critical when evaluating decisions made by others under uncertainty. Previous research shows that this can be a very difficult task. In a principalagent experiment where an agent’s effort is always perfectly observable, we find an undue influence of luck on punishment decisions made by principals. Our experiment identifies attribution bi...

Moral judgment depends upon inferences about agents’ beliefs, desires, and intentions. Here, we argue that in addition to these factors, people take into account the moral optimality of an action. Three experiments show that even agents who are ignorant about the nature of their moral decisions are held accountable for the quality of their decision—a kind of behaviorist thinking, in that such r...
